Your question is actually incorrect. There really is no such thing as illegal software. You can program viruses legally. However, when you use any software beyond the scope of your network with the intent to harm another computer system, you are now applying it illegally. VNC is a very nice tool, but using it to gain control of a remote system (which you cannot actually do without having already compromised the client by the way) without authorization would be just as illegal as any other script out there.
VNC does however have plenty of legitimate uses (being able to control a headless computer over a network for instance) whereas many “hacking” tools are intended only to test/compromise the security of another network. Hope this clears things up a little for you.
FYI: VNC nor RDP will allow you to gain control of a system configured with default parameters. VNC must have been installed or RDP enabled, and the appropriate ports must have been opened through the router in order for you to even communicate directly with the target computer through the internet.
